What is a special permit?

A Special Permit is authorization to construct a building or establish a use that is not allowed by right.  Special permits are required for expansion or modification of non-conforming uses and structures, as well as for uses specified in the Leicester Zoning Bylaws.  Special permits may only be issued for uses in harmony with the general purpose and intent of the Zoning Bylaw.  Additional criteria for granting of special permits may apply depending on the zoning district and type of special permit requested (refer to the Zoning Bylaw). 

The ZBA issues all special permits for non-conforming uses and structures, as well as all special permits related to signs.  Special permits for other uses are either the ZBA or Planning Board, depending on the district or specific use.  For a listing of special permits issued by each Board, click here.  Please note that fees and submittal requirements are significantly different between the two Boards.
