Application Forms & Instructions

Please review Leicester's Wetland Bylaw (Chapter 14 of the General Bylaws) and Leicester's Wetland Regulations prior to submitting your application.  Leicester's regulations address submittal requirements, documents and plans required, as well as number and size of plans required, for each type of application.

  • Paper copies and electronic versions of all applications, along with applicable filing fees, must be received before the project will be placed on a Conservation agenda.
  • All applications require:
    • The proper MassDEP forms (signed), wetland reports, BVW forms, and such, that pertain to the project.
    • A detailed plan.
    • The applicable local application fee in accordance with Leicester's Wetland Regulations.
    • A Certified Abutters list (300 ft) by Certified Mail/Return Receipt. Certified Abutters List can be obtained from the Assessors Office at least 10 days before the submittal of an application.  
    • A written, detailed project description of work to be performed, to include a description of existing conditions, proposed conditions, wetland delineation information, stormwater information, limits of work (including total area of disturbance), construction sequencing, and how project will contribute to the protection of the interest of the Wetlands Protection Act. Please include any waiver requests associated with Leicester's 25' no disturb zone.

Complete RDA & NOI applications must be submitted at least 15 days prior to a scheduled Conservation Commission meeting. 
Certificate of Compliance Requests must be received 8 days prior to a meeting.   
Please Note: The Conservation Commission cannot make a decision for NOI's that have not been assigned a DEP number. MA Order of Conditions Timeline for Notices of Intent

For projects that include tree removal: Applicants may show proposed tree removal on RDA or NOI applications/plans for Conservation consideration and if approved, tree removal can be included in the RDA determination or NOI Order of Conditions. RDA or NOI applications/plans that do not include anticipated tree removal or for tree removal requirements after issuance of a permit, a separate Forest Cutting Permit may be required. Does your project require an EPA NPDES Construction General Permit? This EPA permit is required for small construction projects that meet criteria of “1 acre or more of land, or less than 1 acre of land, but that is part of a common plan of development or sale that will ultimately disturb 1 or more acres of land. Construction activity includes earth-disturbing activities such as clearing, grading, and excavating land and other construction-related activities that could generate pollutants.” For more information, see: https://www.epa.gov/npdes/stormwater-discharges-construction-activities. Your engineer would be a good resource for determining whether or not your project(s) need a NPDES CGP.
